Terms of Service for Pep Group Organizer

1. Definitions

• "Site," "We," "Us," "Our": Refers to PGO and the website https://pgo.pyr0.dev.
• "User," "You," "Your": Refers to any individual who accesses or uses the Service, including Participants and Organizers.
• "Group Buy": An arrangement facilitated through the Site where an Organizer coordinates the bulk purchase of a product or service on behalf of multiple Participants.
• "Organizer": A User who creates, manages, and is responsible for a Group and potential Group Buy(s).
• "Participant": A User who joins a Group Buy organized by an Organizer.

2. Description of Service

PGO provides a private, community-based platform that allows Users to discover, join, and manage Group Buys.

Our Service is strictly a platform for connection and organization.

• We are not a retailer or seller. We do not sell, manufacture, stock, or ship any products. All products are sourced and managed by the independent Organizers.
• We do not process payments. All financial transactions, commitments, and payments for a Group Buy occur directly between the Participant and the Organizer, completely outside of our Service. We are never a receiving or transmitting party to any financial transaction.
• We are not an auctioneer, agent, or intermediary for any transaction. Our role is limited to providing the online space for Users to connect.

3. Eligibility and Access

• You must be at least 18 years old to use the Service.
• Access to the Site is private. New Organizers may only be permitted to create Group Buys after being vouched for by one or more existing, trusted Organizers, and only at our sole discretion.
• You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

4. The Role of the Platform (Limitation of Responsibility)

You acknowledge and agree that the Site is a neutral venue and we are not a party to any agreement or transaction between Users. We have no control over, and assume no responsibility for, the actions of any User.

By using the Service, you explicitly agree that PGO is NOT responsible for:

• The conduct, actions, or inactions of any Organizer or Participant.
• The quality, safety, legality, or existence of the products or services offered in a Group Buy.
• The truthfulness or accuracy of any descriptions provided by an Organizer.
• The ability of an Organizer to deliver the promised products or services.
• The ability or commitment of a Participant to complete a payment or fulfill their obligations in a Group Buy.
• Any loss or damage, financial or otherwise, incurred as a result of a failed, delayed, or fraudulent Group Buy.

Any dispute, disagreement, or claim you have with another User (whether an Organizer or a Participant) is solely between you and that User. You release PGO (and our officers, directors, agents, and employees) from any and all claims, demands, and damages arising out of or in any way connected with such disputes.

5. User Conduct

You agree not to use the Service to:

• Violate any local, state, national, or international law.
• Infringe on the rights of others, including patents, trademarks, trade secrets, copyright, privacy, or other proprietary rights.
• Engage in any fraudulent activity, including but not limited to misrepresenting your identity or the details of a Group Buy.
• Harass, abuse, or harm another person.
• Distribute spam or any other unsolicited commercial communications.

Although we do not actively monitor for the above items, any misuse for spam, harassment, or abuse will result in immediate removal from the platform with no guarantee of data retention. We are not responsible for dissemination of information by the Organizers, Admins, or Mods that report the information. Infringement of trademarks and other copyright issues will require us to respond as deemed in the request, but will not likely result in any in depth administrative actions.

6. Privacy and Data

Our commitment to your privacy is paramount.

• No Sale of Data: We do not and will not sell, rent, or trade your personal information to any third parties for marketing purposes.
• Anonymized Analytics: We may collect and analyze usage data for the purpose of improving our Service. All such data is anonymized and aggregated, and will never expose individual user data.
• Data Access by Organizers: To facilitate a Group Buy, an Organizer will require certain information from Participants. When you join a Group Buy, you consent to share your User profile information with the Organizer of that Group Buy.
• Personally Identifiable Information (PII): A specific Group Buy may require you to provide additional PII, such as your full name, shipping address, and phone number. You understand that you are providing this information directly to the Organizer through our platform's interface. While we take reasonable measures to secure our platform, we are not responsible for how an Organizer handles, stores, or secures your PII. You share this information at your own risk.
• Shared Analytics: Organizers may have the option to enable and view analytics for their specific Group Buys. They may also have the option to share these anonymized analytics with the broader Site community for informational purposes.

7. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, PGO makes no representations or warranties of any kind, express or implied, regarding the use or the results of this Service in terms of its correctness, accuracy, reliability, or otherwise.

PGO shall have no liability for any interruptions in the use of this website.

To the fullest extent permitted by law, in no event shall PGO be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service, including any Organizer or Participant; (iii) any transaction or relationship between you and any other User; or (iv) any failed, incomplete, or fraudulent Group Buy.

8. Indemnification

You agree to indemnify, defend, and hold harmless PGO, its affiliates, officers, directors, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

9. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We may not provide any direct contact about most changes to these terms, but we will make every attempt to do so for all changes with a notice on the website itself. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
